Additional information on the protection of personal data

INFORMATION ON PERSONAL DATA PROTECTION

The personal data provided by means of the following form shall be processed by the National Anti-Fraud Coordination Service of the State Administration's General Intervention for the purpose of investigating irregularities and cases of fraud in the European Union's financial interests and, where appropriate, for the processing of the legally established procedures for the purpose of demanding the responsibilities that arise in each case. He or she may exercise his or her rights before the controller. Before submitting to the form you must read the additional information on data protection, regulated in Organic Law 3/2018 of 5 December on Personal Data Protection and Digital Rights Assurance.

PURPOSE OF PROCESSING:

Administrative investigation of irregularities and cases of fraud in the financial interests of the European Union and, where appropriate, for the processing of the legally established procedures for the purpose of demanding the responsibilities that come from each case.

LEGAL BASIS FOR PROCESSING:

GDPR: 6.1.c) Processing necessary for compliance with a legal obligation applicable to the controller.

In accordance with Article 8 of the LOPDGDD, the legal basis is supported by, inter alia:

  • Paragraph 2(a) of Additional Provision 25 of Law 38/2003 of 17 November, General for Grants.
  • Article 21.3 of Royal Decree-Law 36/2020 approving urgent measures for the modernisation of public administration and for the implementation of the Recovery, Transformation and Resilience Plan.

RECIPIENTS OF DATA:

Communication to public bodies and entities, the European Anti-Fraud Office, the Public Prosecutor's Office and the European Public Prosecutor's Office is envisaged. This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

DATA TRANSFERS:

No international data transfer is envisaged.

DATA RETENTION PERIOD:

The data shall be kept for the time necessary to fulfil the purpose for which they were collected and to determine the possible responsibilities arising from that purpose.

At the end of this period, its preservation will be subject to its possible consideration as a documentary file, in accordance with the provisions of Law 16/1985 of 25 June of the Spanish Historical Heritage, and Royal Decree 1708/2011 of 18 November, regulating the Spanish Archives System, as well as the documentary management of the Ministry of Finance.

AUTOMATED DECISIONS:

There are no automated decisions.

RIGHTS OF THE DATA SUBJECT

The data subject may exercise, where appropriate, the rights of access, rectification, erasure, restriction, opposition to the processing of data (and to oppose the adoption of automated individual decisions, including profiling, which have legal effects on him or her, or significantly affect him or her in a similar way, as provided for in Article 22 of Regulation (EU) 2016/679) by addressing the controller in person at any of the offices of the Registries Assistance Network (https://administracion.gob.es) or through the electronic headquarters of the Ministry of Finance.
