This function is assigned to the General Comptroller of the State Administration by article 85.3 of Law 40/2015, of 1 October, on the Legal Framework for the Public Sector, and it consists of verifying, for all entities that make up the institutional state public sector, from their creation to their dissolution, their compliance with the requirements set out in said Law, and more specifically:
- The continued existence of the circumstances that justified their creation.
- Their financial sustainability..
- The existence of grounds for dissolution in the event that the entity does not fulfil the purposes for which it was created, or if it is verified that its existence is not the most suitable way of achieving said purposes..
The
Order HFP/371/2018, of 9 April was recently approved. It regulates planning, implementation and evaluation as part of continuous supervision of entities that make up the Institutional State Public Sector, which regulates work that should be performed by the General Comptroller of the State Administration as regards continuous supervision.
